PEMBARUANHUKUM KELUARGA DI YORDANIA DALAM TINJAUAN MAQASHID AL-SYARI’AH

Abstract

Jordan uses the Intra-doctrinal Reform method in family law reform because it combines the opinions of various sects of priests and leaves the school of thought they adhere to. Jordan follows the Hanafi school, but the reform of family law is carried out by adding various opinions from other schools without having to leave their own school with considerations of benefit. The main issues in this study include: first, how is family law reform in Jordan? Second, how is maqashid al-syari'ah review of family law reform in Jordan? Then, the library study is this type of research because the study materials and data are taken from various library literatures that have relevance to the study conducted through a qualitative study with a normative-juridical approach presented with an analytical descriptive method. Meanwhile, this study concludes that family law reform in Jordan is divided into two aspects of the problem, namely munakahat and Mawaris. Then in the review of maqashid al-syari'ah on family law reform in Jordan, various provisions that are universal in nature from basic values ​​in Islam take into account the maslahah aspect, and also look at the mafsadah that will be caused by the regulations in the family law reform.
